General terms and conditions (GTC) of Konsens for the use of the web shop and the purchase of products in the web shop
By using the Web-Shop you declare your agreement to be bound by these GTC. Therefore, please read the GTC carefully before using the Web-Shop.
If you use the Konsens Web Shop, you are responsible for the safekeeping of your account information (username and password) and for restricting access to the browser used to use the Web Shop. You are obliged to inform us immediately if you suspect that an unauthorized third party has obtained knowledge of the account data or if you are concerned that a third party has gained unauthorized access to your account data or your account. You represent and warrant that the information provided by Konsens regarding your use of the Web Shop is accurate and complete and will be updated by you whenever such information changes.
Konsens reserves the right to restrict or block your access to the Web Shop and to close your account if you violate any law or these Terms and Conditions.
Communication with Konsens
By using the web shop or sending e-mails to Konsens, you communicate with us electronically. You agree that Konsens may communicate with you electronically for contractual purposes and may send you any consents, notices or other communications electronically unless otherwise required by mandatory law.
Terms and Conditions of Sale
Conclusion of contract
Your order represents an offer to us to conclude a sales contract between you and Konsens. By completing the ordering process, you are placing a binding order for the products contained in the shopping cart. The confirmation of receipt of the order follows immediately after sending the order. As soon as we have received your order, you will receive an order confirmation from us (by e-mail). The sending of this order confirmation does not constitute an acceptance of your offer, but merely confirms the receipt of your order. However, we are not obliged to accept your purchase offer.
A sales contract between you and Konsens is only concluded when we hand over the products ordered by you for dispatch to you and send you a dispatch confirmation (by e-mail).
The stated prices for the products are net prices including value added tax.
Revocation and return
It is important to us that you love the buying process and the products of Konsens and are satisfied. Therefore, if you are not satisfied and wish to return the goods, please return the package containing the goods to us within 21 days of the day on which you or a third party, other than the carrier and nominated by you, took or has taken possession of the goods. In order to exercise your right of cancellation, you must inform us by means of a clear statement (preferably by e-mail: firstname.lastname@example.org) of your decision to cancel this order. Refunds that are more than 21 days in the past will not be processed.
Order quantities and security
Please note that Konsens sells the products available in the web shop to you only in household quantities and for personal use. Your order to Konsens will be transmitted encrypted, so that third parties have no access to the transmitted data.
For orders up to an order value of CHF 100.00, Konsens will charge you, depending on the country, a shipping fee depending on the weight per package. From an order value of CHF 100.00 the delivery is free of charge worldwide.
Payment can be made by PayPal, PostFinance (Card & E-Finance), TWINT or credit cards. In Switzerland, purchase on account is also possible. It is not possible to deduct a discount. We reserve the right to offer you only certain methods of payment for the requested delivery, for example, to hedge our credit risk, only those that correspond to the respective credit rating.
Payment by PayPal
You pay directly via your PayPal account. After submitting your order you will be redirected to PayPal and there you can pay the order value. As soon as our PayPal account has been informed about your authorization, the shipment will take place – depending on the delivery time indicated at the article. When ordering, your PayPal account will be debited with the actual invoice amount after deduction of any discounts, gift vouchers, etc.
Payment by credit card
You pay directly in the order process by entering your credit card details. When ordering, your credit card will be charged with the actual invoice amount after deduction of any discounts, gift vouchers, etc.
Purchase on account with installment facility (POWERPAY)
MF Group / POWERPAY offers the payment method “purchase on account” as an external payment service provider. With the single invoice you can easily pay for your online purchase by invoice. If you choose not to pay within the specified time frame, you will receive a monthly invoice with an order overview in the following month.
When the purchase contract is concluded, POWERPAY will take over the resulting invoice claim and handle the corresponding payment modalities. Transfer of risk and retention of title
Benefit and risk with regard to the ordered products are transferred to you upon delivery for shipment by consensus. The delivered products remain the property of Konsens until full payment has been received.
Liability and limitation of liability
The liability of Konsens is limited to the legally permissible minimum – unless otherwise expressly regulated in these GTC. This means in particular that:
• Konsens rejects liability for indirect and consequential damages (e.g. compensation for consequential damages and financial losses, unrealized profits, loss of interest) in full;
• Konsens excludes liability for auxiliary persons for gross negligence and unlawful intent;
• Konsens rejects liability for non-contractual damages in their entirety; the mandatory legal provisions of the Product Liability Act remain unaffected.
Applicable law / legal venue
Rights and obligations arising from this agreement are subject to Swiss substantive law (OR/ZGB), excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of performance is Hausen, Canton Aargau. The place of jurisdiction is at Konsens’ place of business; Konsens has, however, the right to bring the dispute before all other courts that would normally be competent for you in the absence of an agreement on the above-mentioned place of jurisdiction.
